The Office of Legal Counsel, deeming all forms of interstate online gambling to be illegal, has caused legitimate concerns for the U.S. gambling industry. The revised opinion has been received with caution and confusion by stakeholders looking to take advantage of the growing legalisation of sports betting across the country to advance their iGaming efforts. However, the predicted challenges of enforcing the opinion, given modern day intermediate routing and data sharing infrastructures, has some in the community believing this will inevitably lead to a review of the law through federal intervention. This debate will discuss the potential consequences, both short and long term, of the Wire Acts application and practicality for modern-day use.
